Why §2257 Does Not Apply Here

§2257 and Part 75 require producers of visual depictions of actual human beings engaged in sexually explicit conduct to verify each performer's age using government-issued identification and to maintain those records in a regulated format. The statute applies only where a real, identifiable human performer exists and was photographed, filmed, or otherwise captured.

The characters featured on Charmuse — their images, names, biographies, and persona descriptions — are generated by artificial-intelligence models. There is no underlying human performer, no real-world photo shoot, and no real person whose age could be verified, because no real person is depicted. As a result, there is no "performer" for whom §2257 records could exist, and the statute's recordkeeping regime does not apply.

This conclusion is consistent with §2257's text, which by its terms applies to "any person" who produces a visual depiction "of an actual human being" engaged in covered conduct (see 18 U.S.C. §2257(h)(1) defining "performer" to mean any human being).

No Real-Person Likenesses

No character image, profile, persona prompt, or description on Charmuse is intended to depict, represent, or imply any real, identifiable person — living or deceased, public figure or private individual. Our content-generation pipeline is designed to avoid the use of real-person training prompts (e.g., the names of celebrities, public figures, or private individuals). Any resemblance to a real person is unintentional and coincidental.

Third-Party Affiliate Platforms

Charmuse links out to third-party AI companion platforms via affiliate URLs. Those platforms are independent businesses that operate their own services, host their own content, and maintain their own §2257 compliance posture for any real-person content they may publish. Charmuse does not control or host the content of those platforms. Users accessing third-party platforms via Charmuse are subject to those platforms' own §2257 statements, terms, and policies.

Age Verification and Site-Wide Gating

Although §2257 does not apply to fictional AI characters, Charmuse takes the adult-only nature of its content seriously. Our age controls include:

• 18+ affirmation on signup. All users must affirm they are at least 18 years of age (or the age of majority in their jurisdiction, whichever is greater) before creating an account.
• Adult content metadata. Every page on charmuse.com is served with the <meta name="rating" content="adult"> tag so parental-control software and content filters can detect and restrict access.
• Visible labeling. Charmuse is labeled as an adult site in its branding, marketing, and on-site disclosures.
• Account-level termination for any user later determined to be under 18, with deletion of associated data.

Reporting Concerns
